GENERAL TERMS OF SALE
The General Terms of Sale and Use are drafted in Italian. In case of discrepancies between the Italian version and any translated version, the Italian version shall prevail.

Sale on the Website to Consumers
These General Terms of Sale are concluded between BRUNELLI & CO SRL, a company governed by Italian law with a share capital of €30,000, registered with the Milan Business Register under no. MI1704316, VAT no. 03817060969, and with its registered office at Viale Luigi Majno 32, 20129 Milan, hereinafter referred to as "BRUNELLI & CO SRL" or "PIETRO BRUNELLI", and any natural person acting as a consumer (i.e., not for professional purposes) who wishes to make a purchase through the Website, hereinafter referred to as "the Buyer". These terms govern the contractual relationship between the parties.
Orders from professionals or entities deemed to act as such are not accepted, particularly if the order volume exceeds the typical needs of a consumer or falls within an abnormal pattern of repeated orders to the same billing or shipping address.
Some offers may be promoted via affiliate platforms or commercial partners who redirect to the Website. Purchases are completed exclusively on the Website without intermediaries.
It is strictly prohibited to purchase items on the Website, including promotional gifts or benefits, for the purpose of resale, especially on third-party platforms or in stores not affiliated with BRUNELLI & CO SRL.
Any breach of this prohibition may constitute an infringement of the rights of BRUNELLI & CO SRL, including its trademarks (such as PIETRO BRUNELLI), brand image, and copyright. Such violations may result in legal consequences.
These general terms are accessible to all consumers and may be consulted or printed before confirming any order with BRUNELLI & CO SRL.
All consumer orders are governed by the terms in effect at the time of order confirmation.

Acceptance of the Terms
The Buyer confirms having read and understood these General Terms of Sale prior to placing an order.
Order confirmation on the Website constitutes full and unconditional acceptance of these terms, which shall govern the contractual relationship between BRUNELLI & CO SRL and the Buyer.
These terms shall prevail over any other conditions unless otherwise agreed in writing.

Contractual Capacity and Orders by Minors
Non-emancipated minors may not place orders without prior consent from a parent or legal guardian.
In accordance with European regulations, BRUNELLI & CO SRL does not process or store personal data of minors under the age of 16, unless joint consent is provided by the minor and their parent(s) or legal guardian(s).
Therefore, BRUNELLI & CO SRL does not accept orders confirmed by individuals under 16 years of age.
If, despite due diligence, personal data of minors is recorded—either mistakenly or due to deception—such data and any related orders will be deleted immediately.

Order
Placing an order implies acceptance of product prices and descriptions as listed on the Website.
Automatic order registration systems are considered valid proof of the order’s nature, content, and date.
BRUNELLI & CO SRL will confirm order acceptance via email to the address provided by the Buyer. The contract is only deemed concluded upon this confirmation and after payment has been validated by the relevant banking institution.
The Buyer is solely responsible for the accuracy of the information provided. BRUNELLI & CO SRL is not liable for any failure to deliver due to incorrect contact details.
BRUNELLI & CO SRL reserves the right to cancel orders from any Buyer with whom there is an outstanding dispute regarding prior payments.

PRODUCTS
Product Availability
Product availability displayed on the Website reflects real-time stock at the moment the Buyer places the order. However, this information is indicative, as simultaneous purchases by other users may affect stock levels.
If one or more products become unavailable after an order is placed, the unavailable items will be removed from the order, and the Buyer will be informed via email and refunded accordingly.

Promotions
Promotional offers are valid only for the indicated duration and while supplies last.
Promotions applicable to product categories or collections are valid only for the listed products and color variants.
Under no circumstances may the Buyer alter, modify, or apply different pricing than that published by BRUNELLI & CO SRL.

Price
Placing an order implies acceptance of the product prices shown on the Website at the time of confirmation.
Applicable prices are those valid at the time of order confirmation.
Prices are displayed in euros and include VAT for deliveries within the European Union. For deliveries outside the EU, prices are shown exclusive of tax. Final prices may vary depending on the VAT rate of the destination country.
Shipping costs are not included in product prices and will be calculated at checkout, depending on the delivery method selected.
The total order price displayed at the final confirmation stage includes all applicable charges: product price, packaging, handling, and shipping fees.
Any VAT or tax rate changes will be reflected in product pricing.
Once the order is confirmed, prices will not be altered.

Price Reduction Announcements
Discounts and promotional price reductions are based on the annual General Price List, which serves as the standard reference.

Description of the Ordering Process
Placing an order consists of the following steps:
Cart / Address / Delivery Method / Payment
- Step One: Selecting Products
The user selects items and can access their cart at any time. Each product includes a detailed product sheet.

- Step Two: Cart Confirmation
At checkout, the total price is displayed. The Buyer can add, remove, or modify items until final confirmation. Order confirmation obliges the Buyer to proceed with payment.

- Step Three: Account Creation or Login
Users can create an account or log in. Account creation simplifies future purchases and allows access to order history. A phone number, address, and email are required.

- Step Four: Delivery and Payment
The user selects a delivery and payment method. Shipping fees are added to the order total unless waived based on order value. The user then confirms the order.

- Step Five: Payment
The user completes the purchase via the selected secure payment method. For credit card payments, the user is redirected to a secure gateway.

Order Confirmation
Upon successful registration of the order, a confirmation email is sent detailing the order and selected shipping method. This confirmation is subject to verification by BRUNELLI & CO SRL. Orders found to be non-compliant may be canceled.
The confirmation email includes the general terms of sale in effect at the time of purchase.

The Account
Users may create an account even without placing an order. Through the account, users can track orders and invoices.
Cookies are required to create and access an account. The user must provide an email address and choose a secure password. For safety, a strong password is recommended.
Only one account per email is permitted. The user is responsible for maintaining account confidentiality. BRUNELLI & CO SRL is not liable for unauthorized access caused by user negligence.

Change Password
If the password is forgotten, users may click "Forgot your password?" to receive a reset link at their registered email address.

Change Delivery or Billing Information
After logging in, the user may click "Edit addresses" to update delivery or billing information.

Confidentiality of Personal Data
Providing personal data is essential to processing and fulfilling online orders. Without this data, the order cannot be validated.

DELIVERY METHODS AND PARTICIPATION IN HANDLING AND SHIPPING COSTS
The shipping fees incurred by BRUNELLI & CO SRL and paid to the service provider or courier are included in the flat-rate contribution for handling and delivery costs charged to the Buyer. You can check the delivery times and costs on the dedicated page by clicking on this link.

HANDLING AND SHIPPING
Orders are processed and shipped within the next working day.

DELIVERY METHODS
Delivery times may be extended in the event of exceptional circumstances. Deliveries to Sardinia, Sicily, other islands, remote locations, or areas with special tax regimes may require additional time.

CUSTOMS DUTIES
Orders confirmed on the Website and shipped outside the European Union may be subject to taxes and customs duties upon arrival at their destination.
These customs duties and any applicable taxes are the sole responsibility of the Buyer. It is the Buyer’s responsibility to inquire about such charges with the competent authorities in their country.

MAXIMUM DELIVERY TIME AND DELAYS
Delivery times may be extended in the event of exceptional circumstances.
Once the communicated delivery timeframe has elapsed, the Buyer may cancel the order via letter or any written communication on a durable medium, provided BRUNELLI & CO SRL has not yet proceeded with shipping. The contract shall be considered terminated upon receipt of said communication, unless the Buyer has received the goods in the meantime and agrees to retain them.
However, pursuant to applicable law, the Buyer has the right to immediately terminate the contract if the delivery date was an essential condition of the agreement, either based on the circumstances surrounding the contract’s conclusion or due to an express request by the Buyer prior to the conclusion of the contract. In the event of termination, all amounts paid by the Buyer shall be refunded within fourteen days from the termination date.

DELIVERY METHODS
The designated courier will deliver the goods to the address provided by the Buyer to BRUNELLI & CO SRL.
If the Buyer fails to collect the parcel within the period established by the courier, the parcel will be returned to BRUNELLI & CO SRL. In such cases, unless the Buyer contacts BRUNELLI & CO SRL to arrange a new shipment at their own expense, the order will be canceled and refunded (excluding shipping costs).
In case of exceptional delays or loss of goods, the Buyer is encouraged to notify BRUNELLI & CO SRL, who will initiate an investigation with the carrier.
Buyers are strongly advised to check the condition of the parcel upon receipt.
BRUNELLI & CO SRL has three (3) business days (excluding holidays) to file any claims with the courier in the event of damaged or missing items. The Buyer must promptly report any such issues upon receipt.
If the ordered items are stored in different warehouses, BRUNELLI & CO SRL reserves the right to ship the order in multiple packages.
In the event of a partial shipment, any unavailable items will be refunded unless the Buyer agrees to an extended delivery period.

RIGHT OF WITHDRAWAL
The Buyer has the legal right to withdraw from the contract within 14 days from the date of receipt of the goods.
To exercise this right, the Buyer must complete the return request available on the Return Conditions page. After notifying the intention to return, or after printing the return label, the Buyer has 14 days to drop off the parcel with the designated courier or schedule a pickup at the delivery address provided at the time of purchase.
The returned item(s) must have been tried on only in a manner reasonably necessary to assess fit, style, or comfort, and must be returned complete, intact, in their original packaging, and in perfect condition.
Upon valid exercise of the right of withdrawal, the Buyer will be refunded the total amount paid for the returned products, excluding the original delivery costs. Return shipping costs will be deducted from the refund amount (free returns for size or product exchanges are available only in certain countries — see the Return Conditions page for full details). Refunds will be issued via the original payment method where possible. Alternatively, a store credit valid for 12 months or a bank transfer may be offered, based on the Buyer’s preference.
In case of payment by credit card, the amount will be credited directly to the card used. If a gift card or non-refundable voucher was used, a new voucher of equivalent value and validity will be issued.
Returns must be made using the label provided by BRUNELLI & CO SRL. Unsolicited returns will not be accepted or refunded.
Returned items must be in new condition, in their original or equivalent packaging, and must include all accessories, instructions, and documentation.
To initiate the return process, the Buyer must visit the return portal on the Return Conditions page, complete the form, and specify the reason and quantity of items to be returned. Return labels and instructions will be sent via email within 2–3 business days.
Improper use of the product may result in a reduction of the refund amount.
BRUNELLI & CO SRL will inspect all returned items. Refunds are subject to verification of returned goods and/or receipt of the returned product.
BRUNELLI & CO SRL reserves the right to reject returns received outside of the allowed timeframe and to return them to the Buyer at their own expense.
Any benefits or discounts (e.g., free shipping for orders exceeding a threshold) that no longer apply due to a return will be deducted from the refund.
For hygiene and safety reasons, returns are not accepted for briefs or bodysuits that have been tried on, nor for socks or tights if the packaging has been opened. The right of withdrawal does not apply to used underwear or swimwear.

PAYMENT
The Buyer may choose from several payment methods, including Credit Card, Cash on Delivery, PayPal, and Bank Transfer.

Secure payment by credit card
Payments made by credit card are processed via a secure payment gateway. The amount will be charged within 48 hours of the transaction. Accepted payment methods include: Visa / Mastercard / American Express / Maestro.
All data transmitted to the bank validation server is encrypted. BRUNELLI & CO SRL employs only certified secure encryption protocols. Payment details are entered on the secure portal and are never shared in plain text. Real-time checks are conducted by the payment provider to prevent fraud and misuse.
BRUNELLI & CO SRL does not have access to your card details.
Orders will be considered valid only upon payment approval by the payment provider. If authorization is denied, the order will be canceled, and the Buyer will be notified.
In accordance with applicable electronic signature laws, submission of payment details constitutes proof of the order and renders the payment due.

Via PayPal
The Buyer may also pay via PayPal, either by logging into a PayPal account or using Visa or Mastercard without registering.

Fraud prevention
Payments may be subject to verification using the 3D Secure protocol.

Payment disputes
BRUNELLI & CO SRL reserves the right to reject orders from Buyers with unresolved payment issues or previous disputes. Orders may also be blocked in case of suspicious or irregular transactions until the matter is resolved.

Retention of title clause
All goods remain the property of BRUNELLI & CO SRL until full payment has been received.

Warranty
All products are crafted with the utmost care and in compliance with Italian regulations. In the unlikely event that a product is defective, incomplete, or damaged, BRUNELLI & CO SRL commits to replacing or refunding the item. Liability – Force Majeure
BRUNELLI & CO SRL shall not be held liable for failure to perform due to causes attributable to the Buyer, to an unforeseeable third party, or to force majeure.
In such cases, BRUNELLI & CO SRL will notify the Buyer as soon as possible. If the situation persists for more than ONE (1) month, BRUNELLI & CO SRL reserves the right to cancel the order and refund the Buyer.

Updates and changes to the general terms of sale
These terms remain in force for as long as the products are available on the Website.
Although BRUNELLI & CO SRL makes every effort to ensure the accuracy of Website content, it cannot guarantee complete precision at all times. Any technical or typographical errors will be corrected promptly upon identification.
BRUNELLI & CO SRL reserves the right to amend these terms at any time. Updated terms will apply only to sales made after publication.

Invalidity
If any clause is rendered invalid due to a legal or regulatory change or judicial decision, the remaining terms shall remain valid. Any such clause will be replaced by one with similar intent and effect.

Entire agreement
These general terms of sale, together with the order summary, constitute the entire agreement between the parties. In the event of any inconsistency, these general terms shall prevail.

Order storage and archiving
Orders are securely archived in a reliable and durable format to ensure a faithful record.

Amicable dispute resolution and mediation
Complaints will always be handled with goodwill. In case of dispute, the Buyer is encouraged to contact BRUNELLI & CO SRL directly to seek an amicable resolution.
The Buyer may also consult a trade association, consumer organization, or legal advisor of their choice.
Please note: seeking amicable resolution does not suspend legal deadlines. This step is optional and does not preclude the use of other legal remedies where urgent action is necessary.

Applicable law and competent jurisdiction
This Website is managed by BRUNELLI & CO SRL, an Italian company governed by Italian laws on consumer protection and electronic commerce.
The applicable law is Italian law. The language of this agreement is Italian.
In the event of dispute and in the absence of an agreement, the competent court will be the one in the defendant’s place of residence or, at their choice, the place of delivery of the product.
